Terms of Use – Piligrim Delivery

1. Agreement Overview

These terms (“Terms”) constitute a legal agreement between you and Piligrim Delivery Inc. (“Piligrim Delivery,” “we,” “us”). Any person using the PiligrimDelivery.com website (hereinafter referred to as the “Website”) or related mobile applications (hereinafter referred to as the “Applications”) is considered a “User” and agrees to these Terms, which govern their use of the services provided through the Website and Applications (hereinafter referred to as the “Services”). The Services may be provided either on a paid or free basis.

2. Definitions

Definitions for capitalized terms not defined below can be found in Section Sixteen (16) of these Terms.

3. Description of Services

Piligrim Delivery is an online platform that facilitates connections between Participants (as defined below) regarding goods, products, or items (hereinafter referred to as the “Parcel”) that a Participant wishes to send, and the transportation of these Parcels to a specific location (hereinafter referred to as the “Destination”) within an agreed timeframe (hereinafter referred to as the “Delivery Date”).

A Participant who wishes to send a Parcel to a Destination (hereinafter referred to as the “Sender”) may post a request (hereinafter referred to as the “Request”) on the Website, describing the Parcel and the price they are willing to pay for its delivery. The price may be either paid or free, depending on the agreement.

A Participant traveling to the Sender’s Destination (hereinafter referred to as the “Traveling Participant”) may accept the Request by indicating that they agree to the Sender’s terms or negotiate a price, which may be either paid or free.

Once the Sender and the Traveling Participant agree on the terms, they conclude an agreement in the general chat of the delivery application regarding the delivery of the Parcel for the agreed price, which may be zero (free of charge).

4. Principles and Obligations of the Parties

Piligrim Delivery provides a supporting service to facilitate Transactions but is not a party to any Transaction. Piligrim Delivery does not sell, accept, or deliver Parcels. Each Participant is fully responsible for fulfilling their obligations within the Transaction.

5. Application of Local and International Laws

You agree that Sections Two (2) through Five (5) of these Terms apply to all Transactions agreed upon on the Website and in the Applications and supplement any local or international laws governing your Transaction. Piligrim Delivery will not voluntarily intervene in legal disputes between Participants.

6. License Limitation

Piligrim Delivery does not provide escrow services and is not licensed by any relevant authority in Canada. Therefore, the services are not available to consumers residing in jurisdictions that require a license to provide escrow services online to consumers residing in such jurisdictions.

7. Delivery and Import

The Traveling Participant and the Sending Participant agree to: (a) bear full legal responsibility for ensuring that the Parcel can be legally transported and imported to the destination in compliance with all local legal and tax regulations of the destination country, as well as international regulations, and (b) release Piligrim Delivery from any liability or loss they may incur in the event of violating any import laws, customs, or tax regulations. All Participants acknowledge that Piligrim Delivery is not responsible and is not required to guarantee compliance with all applicable laws during the transaction process.

Parcels sent from any country (place of origin) to a foreign destination may be subject to import taxes, customs duties, and fees levied by government authorities upon arrival at the destination. These taxes and fees may include, but are not limited to, local sales taxes, import duties, as well as possible additional local charges that may vary depending on the jurisdiction and the type of parcel. The Traveling Participant is the importer of record and is responsible for complying with all laws, regulations, and tax obligations of the destination country, including any local legal and tax rules that may differ across countries.

Piligrim Delivery does not control and cannot pre-assess or calculate these fees during or before delivery. Customs and tax policies may vary significantly from country to country, and also depend on the type of parcel, its value, and destination. The Traveling Participant should contact the relevant customs and tax authorities in each destination country for detailed information on applicable fees, taxes, restrictions, and local rules that may affect delivery. Violation of import laws, including failure to comply with local requirements, may result in parcel confiscation and penalties.

The Traveling Participant also agrees to comply with all local legal, tax, and customs requirements of each country, including but not limited to laws prohibiting the import of restricted goods, regulations on declaring the value of the parcel, and other regulations. Piligrim Delivery has no control over local legal requirements or policies that may affect delivery and is not responsible for any delays, confiscations, or penalties arising from failure to comply with these requirements.

8. Payment

(a). Platform’s Non-Participation in Financial Transactions:
Piligrim Delivery does not participate in any financial settlements or transactions between participants. All payments and reimbursements occur directly between the Sending and Traveling Participants. The platform only provides functionality for interaction and organizing parcel deliveries.

(b). Price Agreement:
The price for parcel delivery is established directly between the Sending Participant and the Traveling Participant. The platform does not require prepayment, deposits, and does not hold any amounts for services. All payments are made directly between participants within the agreed timeframe.

(c). Free Delivery:
If the participants agree, the delivery may be carried out for free, without any charge for delivery services.

(d). Reimbursement:
Piligrim Delivery does not require the Traveling Participant to provide a deposit. If the parcel is lost or damaged, the Sending Participant can negotiate reimbursement with the Traveling Participant. The Traveling Participant may, if necessary, agree with the Sending Participant to reschedule the delivery date.

(e). Banking Information:
The Sending and Traveling Participants may provide banking information for processing payments and reimbursements, but this information is not stored or processed by the platform. All financial transactions and transfers are made directly between participants, without the involvement of the Piligrim Delivery platform. 

9. Account Registration

To use the Piligrim Delivery platform, you must register as a participant and create an account to view the application and access the content (Piligrim Delivery account). Viewing the application and submitting requests for content does not require providing credit card or bank account information. You can register directly or through a third-party provider, such as Google or Apple. To complete the registration and create a Piligrim Delivery account, you must provide your mobile phone number and email address. You must be at least 18 years old to become a participant and engage in transactions.

You agree to provide accurate, complete, and up-to-date information when registering. Failure to comply with these requirements constitutes a violation of the terms of use and may result in the immediate termination of services and deletion of your Piligrim Delivery account. You must not select or use for registration:
(i) the name, email, or mobile phone number of another person with the intent to impersonate that person;
(ii) the name, email, or mobile phone number that belongs to someone else and requires authorization; or
(iii) a name that is offensive, vulgar, or inappropriate.

Piligrim Delivery reserves the right to reject registration or cancel your Piligrim Delivery account at its sole discretion. You are fully responsible for all actions occurring under your account and must maintain the confidentiality of your account details. If you become aware of any unauthorized use of your account or any other security breaches, you must immediately notify Piligrim Delivery in writing.

You agree to provide accurate, up-to-date, and complete information during registration and update such information before completing a transaction. Piligrim Delivery reserves the right to suspend or terminate your Piligrim Delivery account and access to the website, applications, and services if you create more than one Piligrim Delivery account or if any information provided during registration or later is found to be inaccurate, outdated, or incomplete. You are responsible for safeguarding your account details. You agree not to disclose your account details to third parties and accept full responsibility for all actions or activities conducted under your Piligrim Delivery account, whether or not you authorized such actions. You agree to immediately notify Piligrim Delivery of any unauthorized use of your Piligrim Delivery account. You may not have more than one active Piligrim Delivery account.

10. Termination

We reserve the right to deny services to users who violate these terms, as well as to suspend or cancel their Piligrim Delivery account without prior notice.

11. User Conduct

You understand and agree that you are fully responsible for complying with all applicable laws, rules, regulations, and tax obligations that may apply to your use of the website, services, applications, and content. You agree to take reasonable precautions in all communications and interactions with other users and participants of the website, applications, or services, as well as with others you interact with as a result of using the website, applications, or services, including, but not limited to, all users of Piligrim Delivery, especially if you decide to meet in person, whether such meetings were arranged through the website or applications. In connection with your use of the website, applications, and services, you agree that you will not:

(a) violate any local, state, provincial, national, or other laws or regulations, including, without limitation, laws prohibiting the transport of controlled substances (the definition of which may vary by country), or any court orders, including, without limitation, laws concerning imports and taxes;
(b) use manually or automatically software, devices, scripts, bots, or other means or processes to access the website, “scrape,” “bypass,” or “crawl” the website or content;
(c) use the website, applications, or services for commercial or other purposes not permitted by these terms;
(d) copy, store, or otherwise access any information or content contained on the website or in the applications for purposes not permitted by these terms;
(e) use our website, applications, or content to infringe on the rights of any individual or organization, including, but not limited to, their intellectual property rights, privacy rights, publicity rights, or contractual rights;
(f) interfere with the operation of the website, applications, or services or damage them, including, but not limited to, using viruses, cancelling bots, Trojan viruses, malicious code, denial-of-service attacks, packet spoofing or IP addresses, falsified routing information, or email addresses and similar methods or technologies;
(g) use our website, applications, or services to transmit, distribute, publish, or send any information about another person or organization, including, but not limited to, photos of other people without their permission, personal contact information, or credit/debit card numbers, billing accounts, or service account numbers;
(h) use our website or applications in connection with sending unsolicited commercial emails (“spam”) or advertising not related to our services;
(i) “stalk,” harass another user of our website, applications, or services, or collect or store any personal information about another user;
(j) register more than one Piligrim Delivery account or register an account on behalf of someone other than yourself;
(k) contact another user for any matter unrelated to a transaction or use of the website, applications, and services by that user;
(l) when you are a user, hire or otherwise engage any user to join third-party services or websites that compete with Piligrim Delivery;
(m) impersonate another person or organization, or misrepresent or otherwise present yourself or your affiliation with any person or organization;
(n) use automated scripts to collect information or otherwise interact with the website, applications, or services;
(o) post, upload, publish, send, or transmit any content that: (i) infringes, misappropriates, or violates the patents, copyrights, trademarks, trade secrets, moral rights, or other intellectual property rights of a third party, or the rights of publicity or privacy; (ii) violates or encourages behavior that violates the law or regulation or could lead to civil liability; (iii) is deceptive, false, or misleading; (iv) is defamatory, obscene, pornographic, vulgar, or offensive; (v) promotes discrimination, intolerance, racism, hatred, harassment, or harm to any individual or group; (vi) is violent or threatening, or promotes violence or actions threatening any other person; or (vii) promotes illegal or harmful activities or substances;
(p) systematically collect data or other materials from our website, applications, or services to create or compile, directly or indirectly, in one or more downloads, collections, databases, catalogs, or similar, whether manually, through bots, crawlers, or spiders, or otherwise;
(q) use, display, mirror, or frame the services, applications, website, or any element within the website, including the name Piligrim Delivery, trademarks, logos, or other property, or the layout and design of any page or form contained on the website, without Piligrim Delivery’s explicit written consent;
(r) access, interfere with, or use restricted areas of the website, applications, Piligrim Delivery’s systems, or technical systems of Piligrim Delivery’s suppliers;
(s) attempt to explore, scan, or test the vulnerability of any Piligrim Delivery system or network, or breach security or authentication measures;
(t) avoid, bypass, remove, deactivate, impair, decode, or otherwise circumvent any technological measures implemented by Piligrim Delivery or any of its suppliers or other third parties (including other users) to protect the website, services, applications, or content;
(u) spoof any TCP/IP header packet or any part of the header information in an email or posting, or otherwise use the website, services, applications, or content to send modified, deceptive, or false information about the source;
(v) attempt to decrypt, decompile, disassemble, or reverse engineer any software used to provide the website, services, applications, or content; or
(w) encourage, support, or assist any third party in performing any of the above actions.

12. General Disclaimers and Disclaimer of Warranties

If you choose to use the website, applications, and services, you do so at your own risk. You acknowledge and agree that Piligrim Delivery is not obligated to verify user data, although you explicitly allow it to do so at its discretion. Any advice or information received from Piligrim Delivery, displayed on the website, or transmitted through the website, applications, or services will not create any warranties unless explicitly stated in these terms. You are solely responsible for all your communications and interactions with any individuals conducted through the website, applications, and services. You understand that Piligrim Delivery does not attempt to verify the statements of users or other content posted on the website. Piligrim Delivery does not make any representations or guarantees about the compatibility of your intended use of the website or services with the actual use of the website by other users.

(a) Lost, Damaged, or Stolen Property. To the maximum extent permitted by law, the parties to a transaction release Piligrim Delivery from any claims and liabilities related to the loss, theft, or damage of property that may occur due to delivery issues, dishonest behavior by a user or participant, or any other reason related to the services.
(b) Taxes, Import and Export Duties. The parties to the transaction agree to protect Piligrim Delivery from any liabilities and fees they may incur for non-compliance with export or import laws, as well as from any liabilities and government charges, including customs duties, VAT, and customs fines or penalties related to the delivery of any parcel.
(c) DISCLAIMER OF WARRANTIES. Piligrim Delivery is not a party to any transaction and does not warrant that the website, applications, content, or services will meet your specific needs or requirements, or that they will be available without interruptions, with security, or without errors. Furthermore, Piligrim Delivery does not guarantee the quality, timeliness, accuracy, completeness, reliability, or truthfulness of any requests, trips, or other content posted on the website or obtained through the website or services.

13. Limitation of Liability

To the maximum extent permitted by law, you assume all risks associated with using the website, applications, and services. Neither Piligrim Delivery nor any party involved in the creation, production, or provision of the website, applications, or services shall be liable for any incidental, special, exemplary, or indirect damages, including loss of profits, loss of data, loss of business reputation, service interruptions, computer damage or system failures, costs of substitute products or services, losses due to personal injury or emotional distress, arising out of or in connection with the use of the website, applications, or services, or in any way related to these Terms. This includes damages resulting from the inability to communicate or interact with users or participants with whom you engage through the website, or any damages you may incur in connection with a transaction or other use of the website, applications, or services (including any trip, request, or parcel delivery through the website, applications, or services).

This limitation applies regardless of whether the claim is based on warranty, contract, tort (including gross negligence), strict liability, product liability, or any other legal theory, even if Piligrim Delivery has been informed of the possibility of such damages, and even if a limited legal remedy set forth in these Terms has failed in its essential purpose.

Your sole remedy against Piligrim Delivery under these Terms and in the event of any damage related to a transaction or use of the website or services is to stop using the website. You hereby waive any rights to claim damages under statutory, equitable, or common law that may arise in connection with these Terms, the website, applications, or services. All limitations of liability in these Terms and the exclusive remedies are fundamental aspects of the relationship between you and Piligrim Delivery.

14. Release of Liability

15. General provisions

(a) Release from Liability.
You agree to release, indemnify, and hold harmless Piligrim Delivery, its parent companies, subsidiaries, and affiliates, as well as their officers, directors, employees, and agents, from any claims, liabilities—even in cases of Piligrim Delivery’s own negligence—damages, losses, and expenses, including but not limited to reasonable legal and accounting fees, arising from or in any way connected to (a) your access to the site, applications, content, or services, or your violation of these Terms; (b) your user-generated content; (c) your (i) interaction with any user, (ii) purchase of any parcels, or (iii) creation of a trip or request.

(b) Entire Agreement.
These Terms constitute the full and exclusive agreement between you and Piligrim Delivery regarding the site, applications, content, and services. These Terms supersede any prior oral or written agreements or understandings between you and Piligrim Delivery regarding the site, applications, content, services, and any transactions.

(c) Assignment.
You may not transfer or assign these Terms, whether by law or otherwise, without the prior written consent of Piligrim Delivery. Any attempted transfer or assignment without Piligrim Delivery’s consent shall be null and void. Piligrim Delivery may transfer or assign these Terms at its sole discretion without restrictions. Subject to the foregoing, these Terms will bind and benefit the parties, their successors, and permitted assigns.

(d) Notices.
Any notice or communication permitted or required under these Terms, including changes to these Terms, shall be made in writing and sent by Piligrim Delivery (i) via email (to the address you provide) or (ii) by posting on the website. For email notifications, the date of receipt shall be deemed the date the notice was sent.

(e) Waiver of Rights.
Failure by Piligrim Delivery to enforce any right or provision of these Terms shall not constitute a waiver of further enforcement of such right or provision. A waiver of any such right or provision will be effective only if in writing and properly signed by an authorized representative of Piligrim Delivery. Except as expressly stated herein, the use of any remedies by either party under these Terms shall not limit its other remedies under these Terms or otherwise. If, for any reason, an arbitrator or a court of competent jurisdiction finds any provision of these Terms invalid or unenforceable, that provision shall be enforced to the maximum extent permitted, and the remaining provisions of these Terms shall remain in full force and effect.

(f) Governing Law, Jurisdiction, Dispute Resolution, and Arbitration.
These Terms shall be interpreted in accordance with the laws of Canada, without regard to its conflict of law principles. You and Piligrim Delivery agree that any and all disputes arising out of or related to your use of the site, content, services, or applications, or any policies or practices of Piligrim Delivery, shall be subject to final and binding arbitration in Canada, in accordance with Canadian law and arbitration rules. 

16. Definitions

The following words and phrases shall have the following meanings for the purposes of these Terms:

“Applications” means any mobile internet application that Piligrim Delivery provides for interacting with the platform.

“Collective Content” means Member Content and Piligrim Delivery Content.

“Content” means text, graphics, images, music, software (excluding Applications), audio, video, information, or other materials.

“Piligrim Delivery Content” means all Content that Piligrim Delivery provides through the Website, Applications, or Services, including any Content licensed from a third party, but excluding Member Content.

“Member” means a person who has completed the registration process on the Piligrim Delivery platform and created an account.

“Member Content” means all Content that a Member posts, uploads, publishes, submits, or transmits for posting through the Website, Applications, or Services.

“Transaction” means an agreement between Members, concluded through the Piligrim Delivery Platform, in which one Member agrees to provide a delivery service and the other agrees to use this service, with possible payment or by mutual agreement.

PRIVACY POLICY

This section of the Terms informs you about the policies and procedures of Piligrim Delivery regarding the collection, use, and disclosure of personal information we receive from Users and Participants (“Privacy Policy”). This Privacy Policy applies only to the information you provide to us through the Website and the Application. We may periodically update this Privacy Policy to reflect changes in our information practices. If we make any substantial changes, we will notify you via email (to the address provided in your Piligrim Delivery account) or by posting a notification on the Website and in the Applications before the changes take effect. We recommend you periodically review this page to stay informed about our privacy practices. For the purposes of this Privacy Policy, the terms “use” and “process” information include the use of cookies on your computer, statistical or other analysis of information, as well as any actions with information, including but not limited to collection, storage, evaluation, modification, deletion, use, merging, disclosure, and transfer of information within our organization or among our affiliates and partners both within Canada and abroad.

(a) International Transfer. YOUR INFORMATION MAY BE TRANSFERRED AND STORED ON COMPUTERS LOCATED OUTSIDE YOUR STATE, PROVINCE, COUNTRY, OR OTHER JURISDICTION, WHERE PRIVACY LAWS MAY BE LESS PROTECTIVE THAN IN YOUR JURISDICTION. YOUR CONSENT TO THIS PRIVACY POLICY, EXPRESSED BY PROVIDING US WITH INFORMATION, CONFIRMS YOUR AGREEMENT TO SUCH A TRANSFER.

(b) Collection and Use of Information. Our primary purposes for collecting information are to provide and improve our Website, services, features, and content, manage your use of the Website and any future or related applications (collectively referred to as the “Service”), as well as to ensure convenient and simple use of the Website. Additionally, personal information is necessary to complete deliveries and shipments. You explicitly consent to the use of your information for these purposes.

(c) Personally Identifiable Information. When you register on our Website or Application and become a Participant, post a trip or route, make a request, or contact another Participant, we may ask you for personally identifiable information and/or obtain it through your third-party account. This includes, but is not limited to, your name, phone number, email address, and mailing address.

(d) Log Files. When you visit the Website or use the Applications, our servers automatically record information that your browser sends when visiting the Website (“Log Data”). This may include your IP address, browser type, pages you visit, time spent on pages, search queries, and other statistical data.

(e) Cookies. We use cookies to store your information and improve the performance of the Website. You may disable cookies in your browser settings, but this may affect the functionality of the Service.

(f) Web Beacons. We may use web beacons (electronic images) to help analyze the use of the Website and evaluate the effectiveness of our ads and newsletters.

(g) User Communication. After completing an agreement for delivery, the sender and traveler may exchange contact information to coordinate the sending and receiving of the package.

(h) Security Measures. We take reasonable measures to protect your information, but we cannot guarantee complete security when transmitting data over the Internet.

(i) Third-Party Links. Our Website may contain links to third-party websites, for which we are not responsible for the privacy practices. We recommend reviewing their policies before providing personal information.

(j) Age Restrictions. Our Services are not intended for individuals under the age of 18. We do not knowingly collect personal information from children under 13. If we discover that such information has been provided, we will delete it.

(k) Contact Us. If you have any questions about the Privacy Policy, please contact us via the support center.

(o) Business Transfer. Piligrim Delivery may sell, transfer, or otherwise share part or all of its assets, including your Personal Information, in connection with a merger, acquisition, reorganization, or sale of assets, as well as in the case of bankruptcy.

(p) Modification or Deletion of Your Information. All Participants may view, update, correct, or delete Personal Information in their registration profile by contacting us at [https://piligrimdelivery.com/contact/] or by editing the relevant part of their profile. If you want to delete your account, go to the Piligrim Delivery.support link or contact us, and we will fulfill your request unless we have legal obligations or legitimate business reasons to retain the information contained in your account. Please note that if you delete your Piligrim Delivery account, any reviews you have posted will remain publicly accessible through the Website and Applications.

(q) Security. Piligrim Delivery takes the protection of your information seriously. We follow industry-standard practices to protect the personal information transmitted and stored. However, no method of data transmission over the Internet or electronic storage is 100% secure. Therefore, we cannot guarantee absolute data protection. If you have questions about security on our Website, please contact us.

In case of a security, privacy, or integrity breach involving your unencrypted personal data (under applicable data protection laws), we are committed to notifying you by email or through a noticeable announcement on the Website as soon as possible, without undue delay, taking into account (i) lawful requests from law enforcement or (ii) any measures necessary to assess the scope of the data breach and restore its integrity.

(r) Links to Other Websites. Our Website may contain links to other websites. If you follow a link to a third-party website, for example by clicking on an ad banner, you will be redirected to that site. The presence of a link to a third-party website does not imply that we endorse, support, or are affiliated with that site. (s) Use of Analytical Tools. We use analytical services such as Google Analytics and Firebase to monitor user activity and improve the quality of the services we provide. These tools may collect information such as your IP address, device type, operating system, browser information, and usage of our Website. (t) User Rights (GDPR). If you are a user from the European Union, you have the right to access, correct, delete, restrict processing, transfer data, and object to processing of your personal data. You can exercise these rights by contacting us using the provided contact information.

(u) Use of Data in Advertising. We may use information collected through cookies and other technologies to display personalized ads in the app and on our website. You can configure privacy settings to restrict the use of personalized advertising.
